IN BALANCE FITNESS MEMBERSHIP TERMS & CONDITIONS - Lakes Entrance

1. General Conditions of Entry & Club Code

To ensure a safe, respectful, and enjoyable environment for all, members must follow these conditions. Breaches may result in suspension or termination of membership.

Access Pass: Entry requires scanning your member tag or QR code in the In Balance Fitness Hub App. Passes are for individual use only.

Entry Restrictions: Entry may be refused or revoked if you:

  • Use abusive, threatening, or inappropriate language or behaviour
  • Are under the influence of drugs or alcohol
  • Engage in behaviour deemed unsafe or inappropriate by In Balance Fitness

No Smoking: Smoking or vaping is strictly prohibited in or around the Club.

Tailgating: Allowing unauthorised entry is prohibited. A $150 tailgate fee applies for breaches. Repeated breaches may result in membership cancellation.

Dress Code: Enclosed sports shoes and appropriate gym attire must be worn. Offensive slogans or imagery are not permitted.

Towels & Hygiene: A clean towel must be used when exercising or attending classes. Towels are available for purchase at reception (subject to availability).

Camera Use: Photography or filming requires permission. Capturing other members without consent is a breach of terms.

Parking: Vehicles are parked at your own risk. In Balance Fitness is not liable for any loss or damage.

Personal Training: Only In Balance Fitness authorised trainers may provide personal training. Training others without approval may result in membership cancellation. PT sessions are booked and paid directly with your trainer.

Emergency system: Emergency system misuse may result in liability for damages

Guests: Must be 16 years or older and pay $15.95 per visit. Members are responsible for ensuring their guests pay and check in via the app outside of manned hours. If the guest does not complete the check in, the member who allowed them entry will be held responsible for the $15.95 guest fee.

2. Use of Equipment & Facilities

  • Return all equipment to its original location (including weights, bars, and class items).
  • Unload plates after use.
  • Follow safety instructions provided on all equipment.
  • Ask staff for help if unsure about proper use.
  • Use a towel and keep phone calls to a minimum on the gym floor.

3. Valuables & Lost Property

  • You bring valuables to the gym at your own risk. In Balance Fitness is not liable for any loss or damage.
  • Bags are not permitted on the gym floor.
  • Lost property is held at reception for 2 months.

4. Membership Inclusions

Your membership includes access to the Lakes Entrance gym facilities during applicable staffed and unstaffed hours, subject to your membership type and the Age Policy. This includes access to the gym floor, strength and cardio equipment, and Fitness On Demand classes.

Classes or services offered independently by personal trainers or other third-party providers operating from the Club are separate businesses and are not included as part of an In Balance Fitness membership unless expressly stated otherwise.

We reserve the right to modify Fitness On Demand services and to upgrade, replace, relocate or temporarily remove gym equipment as required for maintenance, safety or operational purposes.

5. Your Responsibilities

  • Membership fees remain payable regardless of attendance.
  • Inform us of any changes to your contact or payment details.
  • Advise us in writing of any health risks before using facilities or services.

You agree to: Exercise safely and ask for assistance if needed and keep valuables secure

6. Liability Waiver

To the extent permitted by law, In Balance Fitness is not liable for any injury, loss, or damage arising from the use of its services or facilities. In becoming a member with In Balance Fitness, you confirm that you are physically and mentally fit for exercise at In Balance Fitness. You commit to informing instructors of any changes to your health status that may affect your ability to exercise safely.

7. Membership fees

  • Direct Debit Memberships: Direct debit memberships may include an agreed Minimum Term, as specified in your membership agreement. Once the agreed Minimum Term and required number of payments have been completed, your membership will continue on an ongoing basis until you choose to cancel it in accordance with the cancellation terms below. Payments are debited fortnightly.
    • You are responsible for providing a payment method In Balance Fitness and the current debiting company are able to process the payments from. Any issues with a bank account or card you provide may lead to reversal fees, which you are responsible for paying.
    • Once out of the committed term, a Membership Support Fee of $0.90 per
      fortnight will be added to your payments
    • Membership fees remain payable regardless of attendance.
  • Upfront Memberships: Upfront memberships expire at the end of the purchased term and are not automatically renewed. Refunds are not provided for change of mind after the applicable cooling-off period, subject to your rights under Australian Consumer Law. If you choose to renew after your membership expires, a new membership will be at the current applicable rate and terms.
  • Admin Fee: A one-time fee of $55.95 applies to new members. Returning members (less than 3 years) can renew without this fee.
  • Failed Payments: A $6.95 dishonour fee applies for missed payments.

Member Responsibility for Payment Method

  • You are responsible for providing In Balance Fitness with a valid and active payment method, such as a bank account or payment card, from which direct debits can be successfully processed. You must ensure that the payment details provided are accurate and that your financial institution permits direct debits from the nominated account. In Balance Fitness is not liable for any failed payments resulting from incorrect details, account restrictions, or limitations imposed by your financial institution.

8. Special Membership Terms

  • Any special conditions (e.g. Free Time, Discounts) are noted in your membership agreement.
  • Free Time does not count toward your minimum term.
  • Discounted periods revert to standard fees after expiry.
  • Renewing an upfront membership means agreeing to current terms and rates.

9. Age Policy

14 – 15 years

  • All Memberships are only permitted with the consent and signature of the minor’s parent/legal guardian.
  • The parent/legal guardian assumes legal responsibility for performance of the minor’s obligations under this Agreement.
  • Access is permitted only during staffed hours unless accompanied by their nominated guardian, personal trainer or other approved exercise professional.
  • All minors must leave the Club immediately once staffed hours have ended if not accompanied by a nominated guardian.
  • Members in this age group are not eligible to redeem Trial or Guest Passes or similar promotions.
  • All 14 & 15-year-olds are required to complete a compulsory induction session before they can start using the gym facilities.

16 and 17 years

  • Direct debit membership is permitted only with the consent and signature of the minor’s parent or legal guardian.
  • The parent/legal guardian assumes legal responsibility for performance of the minor’s obligations under this Agreement.
  • Access is permitted during both staffed and unstaffed hours, and the minor is not required to be accompanied by a guardian.

9. Fitness Passport Access

In Balance Fitness Lakes Entrance accepts eligible Fitness Passport members, subject to a current and valid Fitness Passport membership.

Fitness Passport users must complete In Balance Fitness registration and access setup before using the Club and must comply with all In Balance Fitness Conditions of Entry, Club Code, safety requirements and applicable policies while using our facilities.

Fitness Passport users must check in through Fitness Passport on each visit in accordance with Fitness Passport requirements. An In Balance Fitness access fob does not replace the requirement to complete a valid Fitness Passport check-in.

Fitness Passport provides access to the standard In Balance Fitness gym facilities available at Lakes Entrance under the applicable Fitness Passport arrangement.

Personal training, classes or services operated independently by personal trainers or other third-party providers, specialist programs, premium services and separately priced activities are not included unless expressly stated otherwise.

Access privileges are dependent on the Fitness Passport membership remaining current and eligible. In Balance Fitness may suspend or remove facility access where a Fitness Passport membership cannot be verified, required check-ins are not completed, or the Conditions of Entry are breached.

11. Cancellation & Termination

Cooling-Off Period:
You have 7 business days from the date of signing to cancel your membership under the cooling-off period. A cooling-off request must be made in writing to mc@inbalancefitness.com.au within the 7-business-day period. All fees paid will be refunded, less any applicable administration fee and access card costs.

Bankruptcy:
You may terminate your Agreement before the end of the Minimum Term if you are declared bankrupt. You must provide an official Notification of Bankruptcy from the Australian Financial Security Authority (AFSA). Membership freeze (suspension) must not be a viable option in your circumstances.

Outside Minimum Term:
Once your Minimum Term has been completed, 7 days’ notice is required to cancel your membership (excluding any period of membership freeze). Any payments falling due during the 7-day notice period must still be paid in full.

Cancellation During Minimum Term:
You may cancel your membership during the Minimum Term provided all instalments and fees due up to the cancellation date have been paid.

If you choose to terminate your membership before the end of the agreed Minimum Term, you are responsible for paying 75% of the remaining balance due under your membership agreement.

Where 75% of the remaining balance is less than $150, the full remaining balance of the membership agreement will be payable instead.

The cost associated with terminating a membership before the end of its agreed Minimum Term reflects:

  • Lower membership rates applied to longer-term agreements
  • Discounted onboarding, administration and marketing fees
  • Full access to membership services already provided
  • The forfeiture of discounts provided in return for a longer-term commitment

How to Cancel:
Cancellations will only be accepted through the In Balance Fitness online cancellation form. Direct debit memberships will remain ongoing until a completed cancellation form has been received.

Cancelling or revoking your direct debit authority, or placing a stop on payments through your bank, does not constitute cancellation of your membership.

Termination by In Balance Fitness:
We may terminate your membership if:

  • You breach the conditions of entry or the terms of this Agreement
  • You endanger staff, other members or yourself
  • You fail to resolve a breach of your Agreement after being given notice
  • We determine that club closure or other circumstances require termination

12. Membership Suspension (Freeze)

Standard Suspension

In-Term Members (Fixed Contract): Memberships may be suspended for up to 26 weeks in total during the Minimum Term at $2 per week.

Out-of-Term Members: Memberships may be suspended at $2 per week.

Standard membership suspensions must be arranged through the In Balance Fitness Hub App or client portal.

If you require a suspension beyond the standard allowance, please contact In Balance Fitness at mc@inbalancefitness.com.au or 1300 609 588. Any extension is subject to management approval.

Please note: In Balance Fitness does not manually suspend accounts unless approval is required. All clients must add a freeze through the In Balance Fitness Hub app or client portal.

Medical Suspension

A valid medical certificate confirming that you are currently unable to exercise is required.

The first 8 weeks of an approved medical suspension are free of charge. An updated medical certificate is required for any extension beyond 8 weeks. After 16 weeks, the standard suspension fee of $2 per week applies.

Total suspension time during a Minimum Term cannot exceed 26 weeks unless otherwise approved by management.

Medical suspensions must be arranged directly with In Balance Fitness staff and cannot be backdated. Please provide at least 3 days' notice where possible.

Freeze periods do not count towards completion of your Minimum Term and will extend the Minimum Term accordingly.

13. Transfer of Membership

Memberships may be transferred to another person during the minimum term only if the transferee is not a current or recent (last 3 months) member, they have not previously been banned or breached terms, they meet the eligibility requirements (e.g. concession or corporate), they complete the full sign-up process. A $50 administration fee is applied to all transfers.

Transfers are only effective once the new member completes sign-up. Transfers are not permitted after the minimum term has expired.

14. Overdue Payments

  • If your account is overdue and no payment is made after being given reasonable notice, your access to the club and any member benefits may be removed. However, all outstanding fees remain payable, and debts will be pursued.
  • The membership remains active and payable, even if access to the facility has been revoked.
  • Returned direct debits will be retried automatically on the next scheduled debit.
  • Continued arrears may be forwarded to a debt collection agency.

15. Debt Collection

  • In the event of repeated failures to meet your payment obligations, your membership may be suspended or terminated upon written notice.
  • This does not affect In Balance Fitness’s right to recover any outstanding amounts, including any contracted payments remaining in your committed period.
  • In the event of payment default, In Balance Fitness may refer your account to a third-party debt collection agency.
  • Referral to a debt collection agency may occur under, but are not limited to, the following circumstances:
    • You cease making payments without formally cancelling your membership
    • You do not respond to our contact attempts
    • You do not provide up to date payment details
  • You are responsible for any additional fees added by the debt collection agency as part of the collection process.

16. CCTV & Safety

  • Our clubs are monitored by CCTV at all times for safety and security
  • By entering, you consent to being filmed for safety and misconduct prevention
  • We store CCTV in line with our Privacy Policy

17. Changes to Terms, Services and Club Operations

We may make reasonable changes to our services, staffed hours, facilities, policies or these Terms & Conditions where necessary. Where a change materially affects your membership, we will provide reasonable notice where required.

Changes may be communicated by email, through our website, via the In Balance Fitness Hub App, club notices or other appropriate communication channels.

Any changes will be subject to your existing contractual rights and applicable Australian Consumer Law.

19. Entire Agreement

This agreement, including all attached terms and policies, represents the full agreement between you and In Balance Fitness, superseding any prior arrangements or discussions.
